1. GENERAL ITEMS

According to Article 43 of the Constitution of Ukraine, Ukrainian citizens have the right to work, that is, to obtain guaranteed work with wages according to their quantity and quality, and not lower than the minimum size established by the state, including the right to choose a profession, the type of occupation and work in accordance with vocation, abilities , vocational training, education and taking into account social needs.

The labor and academic discipline at the Private Higher Educational Institution “International Academy of Ecology and Medicine” (hereinafter – the Academy) is based on the conscious and high-quality performance of employees and persons who study their labor and training responsibilities and is an essential condition for high quality work and high quality learning. Compliance with the discipline of work and study – the first rule of each member of the team.

Labor discipline is based on the deliberate performance by the Academy’s employees of their labor duties and is a prerequisite for the organization of effective work, qualitative educational process. Labor discipline is provided by methods of persuasion and encouragement for good faith. Disciplinary measures are applied to offenders in accordance with the Code of Labor Laws of Ukraine.

The rules of the internal labor regulations (hereinafter referred to as the Rules) are developed in accordance with the Constitution of Ukraine, the Laws of Ukraine “On Education”, “On Higher Education”, Typical Rules of Internal Rules for Employees of State Educational Institutions of Ukraine, approved by the Order of the Minister of Education of Ukraine dated December 20, 1993. No. 455 of the Labor Code of Ukraine and the Charter of the educational institution.

These Rules are aimed at optimization of labor discipline in an educational institution. The rules are aimed at defining the rights and responsibilities of the teaching staff, other Academy staff, and those studying.

The educational discipline of students is based on the requirement of strict adherence to the schedule of the educational process and the requirements of the curriculum in the chosen direction of study and the respect for all participants in the educational process.

The rules are mandatory for all employees, people studying at the Academy, as well as for entrants.

Ignorance of the Rules does not relieve them of their execution and does not remove disciplinary responsibility for their violation.

All issues related to the application of these Rules shall be resolved by the Rector of the Academy within the limits of their authority, and in cases stipulated by the current legislation of Ukraine and these Rules, together with the vice-rector and / or in agreement with the Academic Council of the educational institution.

RIGHTS AND OBLIGATIONS OF THE TRAINING PARTICIPANTS

Students, postgraduates, doctoral students of the Academy have the right to:

To study with the purpose of obtaining a certain educational / educational qualification level;

To continue education by profession, specialty on the basis of the obtained educational qualification level, to obtain additional education in accordance with the agreement with the educational institution;

To receive a referral for study, internship to other educational institutions, including abroad;

Free use of the library of the Academy, use of the academic, scientific, industrial, cultural, sports, home base of the Academy

Use of the industrial, cultural, domestic, recreation bases of the Academy in the manner prescribed by the Charter of the Academy;

Access to information in all fields of knowledge;

Participate in research, developmental and other types of scientific activities, conferences, contests, exhibitions, contests, presentations for publications

Participate in events in educational, scientific, research, sports, artistic, public activities conducted in Ukraine and abroad, in accordance with the procedure established by legislation;

To take part in discussion and decision of questions of improvement of educational process, research work, organization of leisure, life, health improvement;

Personally or through their representatives to participate in the activities of the bodies of self-government of the Academy and the faculties, the Academic Council, the bodies of student self-government with the aim of discussing, solving the issues of improving the educational process, research work, organization of leisure, life, etc .;

To participate in associations of citizens;

On safe and harmless conditions of study and labor;

if necessary, provision of a hostel for the period of training of persons in the manner prescribed by law;

Academic mobility, including international;

To receive social assistance in cases established by law;

For enrollment in the insurance period in accordance with the Law of Ukraine “On Compulsory State Pension Insurance” for periods of full-time study at the Academy, post-graduate courses, doctoral studies, clinical residency, internships, residencies, subject to voluntary payment of insurance premiums;

For an academic leave or a break in the study with the preservation of individual rights of the applicant of higher education, as well as for the renewal of training in accordance with the procedure established by the central executive body for the formation of state policy in the field of education and science;

For moral and / or material encouragement for success in teaching, research and public work, for artistic and sporting achievements, etc .;

On passing the practice at enterprises, institutions, institutions and organizations, as well as for the payment of labor during the performance of production functions in accordance with the legislation;

For a vacation vacation of at least eight calendar weeks for the school year;

To appeal the actions of the authorities of the Academy and their officials, pedagogical and scientific and pedagogical workers, etc .;

For labor activity in the established order at extra-time;

For renewal, transfer to another institution of higher education in the manner prescribed by applicable law;

For a vacation vacation of not less than eight calendar weeks;

To protect against any form of exploitation, physical and mental violence, from acts of pedagogical, other workers who violate rights or humiliate their honor and dignity;

To receive additional social and material assistance at the expense of local budgets, central bodies of executive power, enterprises, institutions, organizations, funds of citizens, legal and natural persons outside Ukraine, charitable organizations, etc.;

In addition to the rights stipulated by the laws of Ukraine “On Education”, “On Higher Education”, students of the Academy have the right to:

To attend classes at other faculties of the Academy upon the permission of the deans (directors) provided that the schedule of the educational process is completed on the main place of study, compiled according to the individual curriculum;

Create funds for student needs.

Duties of persons studying in the Academy:

Adhere to the laws of Ukraine, the statute of the Academy, these Rules and the Rules of Residence in the hostel;

To systematically and profoundly master theoretical knowledge and practical skills in the chosen specialty;

To observe moral and ethical norms, to prevent unlawful and immoral acts;

Increase your general educational and general-cultural level;

To attend classes according to the established curriculum and the established schedule of classes, to inform the management of the faculty in a timely manner in case of impossibility for attending classes for valid reasons, to prepare examinations and tests in accordance with the requirements of the current legislation of Ukraine, to perform control works, etc .;

Maintain proper sanitary and hygienic conditions in the premises of the Academy and adjoining territory;

At the entrance of teachers to stand up to the audience;

It is safe to belong to the Academy, to preserve all types of property of the Academy;

Be disciplined and tidy in the Academy and beyond, to adhere to generally accepted norms of conduct;

Take care of the honor and authority of the Academy;

In time to pay a tuition fee in accordance with the contract;

Come to classes on time and not leave the audience without the permission of the teacher;

Actively prepare for classes and participate in work during classes, while allowing other students to contribute to the learning process;

Refrain from actions that prevent other students or employees of the Academy from fulfilling their official duties.

Persons studying at the Academy are forbidden:

Late for lessons;

Skip without proper reason;

To leave the classroom during classes without the permission of the teacher;

External conversations during classes or create other noise that interferes with conducting classes;

Use a mobile phone while attending classes;

Smoke, burn in the premises of the Academy and the territory adjacent to them;

Without the permission of the Academy’s leadership to take inventory of laboratories, educational and other premises, to use photo and video recording devices.

Use as clothing, when attending class lessons (except physical education), sports suits, beachwear, for rest;

Sit down on tables, window sills, open windows;

Spoil furniture, equipment, room with inscriptions and drawings of any content;

Use expressions that degrade the person’s dignity, including racial, ethnic or national grounds, on the grounds of religious intolerance;

Use abusive vocabulary and obscene gestures;

To use and have alcoholic beverages, narcotic drugs or precursors during their stay in an educational institution, appear to an educational institution in the state of alcohol, narcotic, narcotic or toxicological intoxication;

Deliberately create situations that threaten the physical and moral health of others and well-being;

Bring to the educational institution and use gas cartridges, fire, gas, pneumatic and cold weapons, pyrotechnics, poisonous substances.

In case of admission by the student of absentee exercises without valid reasons, admittance of such person to the session is carried out only after the paid training of her missed training sessions.

The amount of payment for working out missed classes is established by order of the Rector of the Academy.

The semester sessions allow students who have completed all the credits and completed other types of training tasks, provided by the curriculum and programs, individual curricula.

In case of financial or academic debt, the student is not allowed to attend the session.

Students who did not appear on examinations without good reason are considered unsatisfactory.

A student who received academic debts during the session has the right to redeploy it during the first two weeks of the next semester. Repeated examinations are allowed not more than twice from each discipline: once for the teacher, one for the commission, which is created by the dean of the faculty. Graduation tests and examinations are carried out on a fee basis. The size of such payment is set by order of the Academy Rector. Students who for good reason received academic debts have the right to liquidate it within one month after the end of the session on a royalty-free basis.

Students who have received more than two unsatisfactory evaluations during the session may be dropped out of the Academy.

In the presence of academic debt at the end of the academic year, the student is subject to deduction or retention for a re-course.

Refresher courses for students dropped out of an educational institution are carried out during the vacation period.

For non-fulfillment of duties and violation of the Rules of the internal labor regulations of the Academy, the Rector of the Academy may impose a disciplinary penalty on a student (doctoral student, post-graduate student) or deduct it from an educational institution.

4.14. Student may be expelled from the Academy:

4.14.1. Voluntarily;

4.14.2.3a Failure to fulfill the curriculum (unsatisfactory exams and tests during the session, academic debt) and the schedule of the educational process (occupational absences);

4.14.3. In the case of receiving semester control more than two unsatisfactory assessments;

4.14.4. In the case of non-liquidation of academic debts in due time;

4.14.5. In connection with transfer to another educational institution;

4.14.6. For gross violation of the rules of conduct established by these Rules;

4.14.7. For violation of the terms of the contract on the provision of educational services;

4.14.8. For non-payment of tuition for the period stipulated by the contract.

4.14.9. For appearance in educational buildings and auditoriums of the Academy, library, on the territory of the educational institution, at the place of training and production practice in a drunken state, in a state of narcotic, narcotic or toxicological intoxication;

4.14.10. Repeated violation of these Rules during the year after imposing a disciplinary penalty in the form of reprimand;

4.14.11. On the verdict of the court which comes into force;

4.14.12. The unlawful use of physical force, other forms of violence and deliberate attack, beating or committing other unlawful acts of violence that caused other students or employees of an educational institution a physical pain, humiliate their honor or dignity or cause bodily harm;

4.14.13. For a moral image or use of abusive vocabulary during communication with employees of an educational institution when performing their official or official duties;

4.14.14. For gambling in office premises or in the territory of an educational institution;


6. RULES OF BEHAVIOR IN ACCOMMODATION AND ACADEMY. ORDER IN THE ACADEMY.

6.1. During the stay in the premises and at the Academy of applicants for higher education, Academy staff and outside persons (tenants and visitors, etc.) must adhere to the following rules of conduct:

6.1.1. Adhere to the ethics of business communication, the culture of expression, to prevent the use of expressive and / or obscene expressions and gestures, profanity, conversation in high tones, etc.

6.1.2. Adhere to sanitary and hygienic rules and regulations.

6.1.3. To show respect for the personal dignity of a person, his national and religious beliefs, to show mutual goodwill, demanding and respect for people, their cultural, national, spiritual and historical values.

6.1.4. Do not use personal electronic devices (player, mobile phone, tablet, etc.) that prevent the training (providing educational information and its acquisition by higher education) and control measures.

6.1.5. To take a headgear, except female hats, in the premises of the Academy (except for cases of medical indications and religious beliefs).

6.1.6. To place information materials (advertising, postcards, etc.) in premises and in the Academy only with the permission of the responsible person.

6.1.7. Conduct mass meetings and rallies in the premises and in the Academy, entertaining events only with the permission of the Academy Administration.

6.1.8. Come to the Academy in time to be ready to work or study at the beginning of the class or work.

6.1.9.3. In order to create a scientific and business atmosphere in the Academy during the educational process, adherence to sanitary and hygiene norms, the development of aesthetic taste and the culture of clothes for employees and applicants of higher education, it is recommended to observe the rules of business communication and business dress code, namely: to wear a clean, fresh and dressed clothing that meets the standards of a business style commonly accepted by society.

6.1.10. To take care of the honor and authority of the Academy, to prevent unlawful and immoral acts, to behave worthily within the walls of the Academy and in other public places.

6.1.11. Freely move around the territory of the Academy, except for those places where it is forbidden to be for safety reasons.

6.2. The following are prohibited on the territory of the Academy:

6.2.1. Staying outsiders, other than students and employees of the Academy, as well as other persons whose stay is personally agreed with the Rector, Vice-Rector of the Academy.

6.2.2. Conduct any political campaign and call for a violation of law or order.

6.2.3. To use physical violence, psychological pressure, to cause bodily harm. Intimidation and bullying are unacceptable behaviors.

6.2.4. To bring and / or drink alcoholic, alcoholic beverages (except medicines), to be in a state of alcohol, narcotic or toxic intoxication, to bring, use and distribute narcotic drugs, psychotropic substances, as well as smoking mixtures, to perform other acts that are in force the law provides for administrative and / or other legal liability.

6.2.5. Smoking in the premises and on the territory of the Academy, including hookah, electronic cigarettes, etc.

6.2.6. Bring explosives, flammable and toxic substances, firearms, pneumatic, gas and cold weapons, as well as other things that are dangerous to others.

6.2.7. Gaff.

6.2.8. To move furniture, equipment, other material assets, to take inventory from laboratories, educational and other premises without the permission of the leadership of the Academy.

6.2.9. Spoil the property of the Academy or use it for other purposes.

6.2.10. Apply any inscriptions and / or drawings to the walls, tables and / or other places in the premises and on the territory without the permission of the responsible person.

6.2.11. To move in the premises of the Academy on scooters, bicycles, roller skates, boards and / or similar means.

6.2.12. Prevent passageways, create obstacles for traffic.

6.2.13. Cry, make noise, play musical instruments, use sound reproduction equipment with silence and impediments to the educational process.

6.3. Responsibility for the accomplishment of the training facilities (the availability of good furniture, training equipment, support for normal temperature, lighting, etc.) are vice-presidents of the Academy, whose functional responsibilities include the solution of this issue, and the dean of the relevant faculty. 6.4. For serviceability of equipment in laboratories and offices, and for the preparation for the classes correspond to the heads of departments.

6.5. The leadership of the Academy is obliged to ensure the protection of the institution, the preservation of equipment and other educational property, as well as the maintenance of the necessary order in educational and residential buildings.

6.6. Protection of the building, property and responsibility for their fire and sanitary condition rests with certain persons of the administrative staff of the Academy, by order of the Rector or authorized by this person.

6.7. The reception hours of the staff, students, listeners and visitors from the official and personal issues at the Academy are set at the reception hours by the Rector, vice-rectors, deans, deputy deans, heads of departments.

6.8. Keys from the classrooms, laboratories, offices and other premises must be kept by the regular officer of the Academy and displayed on the list approved by the Academy’s leadership.

7. WORKING TIME AND ITS APPLICATION IN THE ACADEMY

7.1. For employees and students of the educational institution a five-day working week with two days off is set. The normal working hours of employees can not exceed 40 hours a week (8 hours a day). On the eve of festive and non-working days, determined by the Labor Code of Ukraine (hereinafter – Labor Code), the duration of work of employees is reduced by one hour. In the case of production needs, a six-day working week may be set up for individual units in agreement with the Council of the labor collective. The start and end time and the lunch break are set for employees by the Rector of the Academy.

7.2. The academic staff of the Academy has a 7-hour working day. For administrative workers and other categories of employees, an 8-hour working day is set. Work part-time is carried out in accordance with the current legislation.

7.3. During a five-day working week, the duration of the daily work of the Academy’s administrative staff is determined by:

Start of work: 9.00;

Break for rest and meals: 13.00-13.45,

end of work: Monday to Thursday – 18.00, Friday – 17.00.

During a five-day working week, the duration of the daily work of the scientific and pedagogical workers of the Academy is determined by: the beginning of work: 9.00; end of work: 17.00.

The mode of work of persons working on the terms of a combination is determined by the order of the Rector of the Academy.

The working hours of persons working on hourly wages are determined by the schedule of classroom training and consultations, the schedule or schedule of control measures and other types of work, as provided by the work plan. The time and place of the work, not provided by the schedule or schedule of control measures, shall be approved by the head of the department, the director of the institute or the rector.

7.3. The working hours of the scientifically-pedagogical, pedagogical workers of an employee are determined

the volume of his teaching, methodological, scientific and organizational responsibilities in the current academic year, reflected in the individual work plan. The amount of study assignments entrusted to a particular scientifically-pedagogical worker, expressed in the accounting (academic) hours, determines his educational load. Types of training sessions, which are included in the compulsory volume of teaching load of the teacher in accordance with his position, are established by the department. The minimum and maximum obligatory volume of the academic load of the teacher within the limits of his working time is established annually by the educational institution, taking into account the fulfillment of other duties (methodological, scientific, organizational) by the scientific and pedagogical worker and in the manner prescribed by the Charter and Collective agreement of the educational institution. *

In cases of production necessity, a scientific-pedagogical worker may be involved in conducting training sessions beyond the obligatory volume of study load, determined by an individual work plan, within the limits of his working time

Schedule of working time of scientific and pedagogical and pedagogical workers is determined by the schedule of classroom training sessions and consultations, schedule or schedule of control measures and other types of work provided by the individual work plan of the teacher. The timing of the work not provided for by the schedule or schedule of control measures is determined in the order established by the educational institution in each individual case, taking into account the special features of the specialty and forms of study.

The scientific-pedagogical worker is obliged to adhere to the schedule of his working time established by him. Within the academic period, scientific and pedagogical staff of the educational institution shall conduct all types of educational, methodological and research work in accordance with the positions, curriculum and plan of research work.

7.4. Before the beginning of work, every employee of the Academy, is obliged to note his arrival to work, and after the end of the working day – the abandonment of work, in the corresponding journal. The procedure for keeping records of working time is determined by the order of the Rector of the Academy.

7.5. The head of the department develops and coordinates the schedule of work of scientific and pedagogical workers in the Academy, indicating the working hours of the employee in accordance with the individual working plan monthly.

7.6. The worker who appeared at work in a drunken state, the management does not allow to work on this working day (change).

7.7. If a teacher or other employee fails to attend, the head of a structural unit must immediately take steps to replace him with another teacher or other employee.

7.8. Overtime work is not allowed. The use of overtime work by the Rector may be carried out in exceptional cases and in the manner prescribed by applicable law.

7.9. It is prohibited during working hours:

7.9.1. Distract scientific and pedagogical workers from their immediate responsibilities for participation in various economic activities, activities not related to the educational process.

7.9.2. Distract employees from performing their professional duties, as well as those who study through work time and activities that are not related to the learning process, except as foreseen by law.

7.10 The right of an employee to annual basic and additional leave of full duration in the first year of work comes after the end of six months of continuous work at the Academy.

7.11. The order of granting of holidays is determined by schedules approved by the Rector or authorized by him and communicated to all employees. When drawing up charts, account is taken of the interests of production, the personal interests of workers and the possibilities of their recreation.

7.12. The duration of the annual main leave can not exceed 56 calendar days. Annual and supplementary leave is granted to the employee in such a way that they are used, as a rule, before the end of the working year. For scientific and pedagogical workers, annual full-time vacations in the first and subsequent working years are provided during the summer holidays irrespective of the time of their recruitment.


9. PAYMENT FOR LOSS OF LABOR DISCIPLINE

9.1. Violation of labor discipline, that is, failure to perform or improper performance due to the employee’s labor duties imposed on him, entails the application of disciplinary or public measures, as well as the application of other measures provided by the applicable law.

9.2. 3a violations of labor discipline, the provisions of these Rules, an employee may be subject to one of the following measures:

a) reprimand;

b) dismissal.

9.3. The compliance of the Rules is controlled by the head of the unit and the administration of the Academy.

9.4. When applying the penalty from the violator discipline required explanation in writing. The refusal of the person who violated the Rules, the written explanation is made by the act and can not be a hindrance to imposing a penalty.

9.5 A disciplinary sanction is applied by the Rector of the Academy or another authorized person to this person immediately after the misdemeanor is discovered, but not later than one month from the date of detection, not taking into account the time of illness or the stay of the employee on vacation.

9.6. The disciplinary penalty can not be applied later than 6 months from the date of the misdemeanor. The specified terms do not include the time of criminal proceedings.

9.7.3. Only disciplinary action may be imposed on each discipline.

9.7.1. For employees of the Academy – after agreement with the council of the labor collective.

9.7.2. For higher education students – after agreement with the student council of the Academy.

9.8. The order on the application of disciplinary sanction with the definition of motives for bringing him to disciplinary liability is announced on a receipt.

In the event of the employee’s refusal to acquaint himself with the order to impose a disciplinary sanction, an act is drawn up.

9.9. If, within one year from the date of the disciplinary sanction, the employee does not commit a disciplinary offense, then he is considered to be not brought to discipline.

9.10 The Rector of the Academy, on his own initiative or at the request of the labor collective, may issue an order to cancel without waiting for the end of the year if the employee did not allow a new violation of labor discipline and proved himself a bona fide employee.

9.11. Depending on the nature and systematic nature of the violation of these Rules, one of the types of penalty may be applied to persons studying at the Academy:

a) warning;

b) reprimand;

c) deductions.

9.12. Disciplinary punishments shall be applied by the Rector upon the submission of the head of the structural unit immediately after the violation is discovered, but no later than one month from the day his discovery, not taking into account the time of the offender’s illness or his stay on vacation. The disciplinary penalty can not be imposed later than six months from the date of the violation. *

9.13. Disciplinary punishment is announced in the order (disposal) of the Rector and the offender is subject to a receipt. Information about the disciplinary penalty is entered into the personal file of the graduate of higher education.

9.14. If during the year from the date of disciplinary enforcement to a higher education student, a new disciplinary penalty is not imposed, it is considered to be non-disciplinary.

9.15. If the applicant of a higher education did not admit a new discipline violation and honestly performed his duties, the penalty may be canceled up to one year.

9.16. During the period of disciplinary action, incentives to higher education are not applicable.

10. TRAINING SCHEDULE

10.1 Training classes at the Academy are scheduled in accordance with the curricula and programs approved in accordance with the established procedure.

10.2 Reductions in the length of vacations set by curricula are not allowed.

10.3 The training schedule is for the semester and is posted no later than 10 days before the beginning of each semester.

10.4 The duration of the academic hour is 45 minutes. After an academic hour, a break of 5 minutes is set.


10.5 After the beginning of classes in all educational and auxiliary premises, there should be silence and order. Interrupting training sessions, entering and leaving without urgent need from the audience during their conduct is prohibited.

10.6 Before the beginning of each training session in the classrooms, labs, labors prepare the necessary teaching aids and equipment.

10.7. For conducting practical classes each course is divided into groups depending on the nature of practical classes.

10.8. In each group, the dean of the faculty is appointed head of the most successful and disciplined students. The senior group is directly subordinate to the dean of the faculty, informs the entire group of all his orders.
